These Terms of Service (“Terms”) govern your use of the ShmegWorks website and the purchase of products from our store (the “Site”). By accessing the Site or placing an order, you agree to these Terms.

1) About ShmegWorks

ShmegWorks (“we,” “us,” “our”) sells made-to-order apparel and accessories through this Site. Our products are produced and shipped by a third-party fulfillment partner.

2) Eligibility

By using this Site, you represent that you are at least the age of majority in your state or province of residence, or you have permission from a parent or guardian.

3) Orders and acceptance

All orders are subject to acceptance and availability. We may refuse, cancel, or limit orders at our discretion, including in cases of suspected fraud, pricing errors, or inventory/production constraints.

4) Made-to-order products and fulfillment

Most items are made to order. Production and shipping times are estimates and not guarantees. We are not responsible for delays caused by carriers, customs (if applicable), weather, or events outside our control.

5) Pricing, taxes, and payment

Prices are shown in [USD] unless otherwise stated. You agree to pay the price listed at checkout, including any applicable taxes and shipping fees. We may update pricing at any time, but changes will not affect accepted orders.

6) Shipping and delivery

Shipping options and estimated delivery times are displayed at checkout. Title and risk of loss transfer to you upon delivery to the carrier, where permitted by law. If your tracking indicates delivery but you did not receive the package, please contact us promptly so we can assist.

7) Returns, refunds, and replacements

Our Refunds & Returns Policy is incorporated into these Terms. Because items are made to order, we do not accept returns or exchanges for change of mind or incorrect size. We will replace or refund items that arrive damaged, defective, misprinted, or incorrect when reported within the timeframe stated in our Refunds & Returns Policy.

8) Address accuracy and returned packages

You are responsible for providing an accurate shipping address at checkout. If an order is returned due to an incorrect/incomplete address or because it was unclaimed, we may require additional shipping fees to reship the item. If an order cannot be reshipped, we may issue a refund minus shipping and handling costs, where permitted.

9) Product colors and appearance

We do our best to display product colors and designs accurately. However, colors may appear differently depending on your device or monitor, and slight variations in print placement or color may occur due to the production process.

10) Promotions and discount codes

Discount codes and promotions are subject to terms stated at the time they are offered. Unless otherwise specified, discount codes cannot be combined and may not apply to shipping, taxes, or certain items.

11) Intellectual property

All content on this Site, including our branding, product listings, text, and design assets, is owned by ShmegWorks or used with permission and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our written permission.

12) Prohibited uses

You agree not to use the Site for unlawful purposes or in a way that could harm the Site, our business, or other users. This includes attempting to interfere with the Site’s security, scraping content, or submitting fraudulent orders.
